The Legal Jargon: Kits

A-Z Creativity LLC will be providing kits/boxes of supplies and instructional items to the Client to be used as indicated in the enclosed instructions. Client agrees to read the instructions carefully and to use the products and supplies as indicated and not for any other reason or purpose. Client assumes full and sole responsibility for the custody and safety of said products and supplies and warrants that they will be used by Client, and anyone else, for their intended purposes only. Such products and supplies may include small parts and items that may present a choking hazard or other risks to life and person for children. Client assumes such risk and will take any and all precautions, if that is the case, and waives any and all claims against A-Z Creativity LLC for any such injuries or damages.

Client also assume full responsibility and any and all risk associated with the use of said products and supplies that may occur from their use by Client or others, including but not limited to children and pets, and agrees to indemnify, hold harmless and, at our option, defend A-Z Creativity LLC, and its agents, from and against all damages, injuries, claims, demands, liabilities, costs, and expenses, including reasonable attorneys' fees resulting from any claims or suits relating to the use or misuse of said products or supplies.

Client hereby waives any and all claims against A-Z Creativity LLC and its agents for any injury or damage to any person or property from said products and supplies resulting from any cause whatsoever. 

All of the above representations apply to Client’s assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives.

Intellectual Property Statement 

Client hereby agrees that A-Z Creativity LLC, retains all copyright, trademark, patent and any and all other intellectual and creative rights, entitlements and ownership, to all materials presented, delivered or shared with Client. Client agrees not to republish, distribute, record, or reproduce, or transfer, in any known or currently unknown manner, any of the materials provided to Client.
